Legal and regulatory aspects
Animal care products are not covered by the Cosmetics Regulation. Article 2(1a) of Regulation (EC) No 1223/2009 specifies that only substances or mixtures intended for external use on humans are considered cosmetic products. In addition, the German Medicines Act stipulates in Section 2(3)(4) that grooming products for animals are not considered veterinary medicinal products and are therefore not subject to the corresponding approval procedure, provided that they are actually intended only for the grooming of animals and do not contain any pharmacological active ingredients. According to Section 2 (6) No. 7 "Cleaning and care products" of the German Food, Commodities and Feed Code, animal care products are to be regarded as commodities for the household. Thus, they are subject to the LFGB only to this extent, but there is no obligation to obtain approval. However, both the manufacturer and the distributor are obliged to ensure product safety with regard to human health and to comply with the provisions of the LFGB. The monitoring authorities of the federal states carry out random checks to ensure compliance with the regulations and guidelines. In addition, the Animal Welfare Act must be observed in all cases when using animal care products.
